The National Institute of Communication Technologies (INTECO) and Anova IT Consulting (ANOVA) publish the Video surveillance and personal data protection guide, which analyses the legal requirements for installing a video surveillance system.
The document, which is available for reference, on both organisations’ websites www.inteco.es and www.anovagroup.es respectively, provides the key to understanding how to operate and implement video surveillance.
A person’s image, insofar as it can be identified or identifiable, constitutes personal data and the improper handling of it may pose a risk to the privacy and intimacy of that person. Therefore, the legally-protected rights affected by this practice are set out, the applicable regulations, the principles and general rules regarding video surveillance, the obligations of those responsible and the rights of those filmed.
On this basis various applications are identified, such as capturing images in a neighbourhood community, at a sporting event, in a shopping centre, or in a business setting, for work-control purposes, amongst others. The obligations with regards to the use of video surveillance systems for each of these cases are established in accordance with data protection regulations, as well as specific regulations for each case.
